Criminal proceedings against former Rwanda Education Board Executives continued today at the trial chamber of Gasabo Intermediate Court.
Prosecution charges were presented on Friday. The case commenced on Wednesday July 10, but one of the suspects did not have a defence lawyer, prompting the judge to adjourned the hearing.
Prosecution presented charges before the judge today against suspects.
Prosecution submitted that the suspects, together with the contractor, be charged with embezzlement and complicity to embezzle public funds, contrary to Law Number 54/2018 on fighting aganst corruption.
Dr. John Rutayisire and Janvier Gasana are currently under temporary detention, after being sent back to jail on May 26, 2019, a month after they had been released on bail.
On April 10, the Court of First Instance in Kacyiru ordered for the immediate release of the suspects, after dismissing the prosecution’s plea that they remain under custody.
Prosecution appealed against the court’s decision, which saw the court order sending them back to jail, provisionally.
Rutayisire was head of REB in 2011, and was replaced by Janvier Gasana in 2015.
They were arrested on March 21 by the Rwanda Investigation Bureau (RIB) for allegedly conniving to fraudulently award a tender to hire a warehouse for storing computers and insuring them against damages and loss.
The contractor, FRANCOIS NAMBAJIMANA, who had been on the run, eventually showed up and has apparently been cooperating with authorities over his charges.
The tender in question involved renting a warehouse at a tune of about Rwf16 million per month for about 100,000 laptops meant for the One Laptop per Child program.
Meanwhile, Rusatsi Ngemanyi Juvénal, one of the suspects, was not detained. He will answer charges while out of jail.
In court today, the defence team denied all charges against the suspects and pleaded for the release of their clients. Prosecution maintains they should be prosecuted against the alleged charges.
Case adjourned to 19, July as the suspects remain in custody.
